Terms of Service - Hextech Software

1. Services

Hextech Software builds custom Websites, Progressive Web Apps (PWAs), and Native iOS & Android apps. Every project includes source code, database, and hosting setup. You own GitHub + database Day 1 after final payment.

We offer three product lines:

• Website — $500 base: 3-5 pages, responsive, login/auth, lead capture to YOUR MongoDB, admin dashboard to edit from phone. Pick background: Premium Clean (fast, no Three.js) or Immersive 3D (3JS / Three.js / React Three Fiber).
• PWA — $750 to $2,500+: Starter $750 (Website + installable, app icon, tap-to-call, share, offline), Growth $1,500 (push + SMS marketing, simple bookings, QR, coupons), Pro $2,500+ (real live calendar, no double-booking, payments, staff, class scheduling). Background style included at every tier.
• Native — Starting at $5,000: Real iOS + Android apps from one React Native codebase, App Store & Play Store submission handled. Camera, GPS, FaceID, biometrics, offline. Same background choice: Premium Clean or 3JS Immersive 3D.
• Background Styles: Premium Clean = fast, no Three.js. Immersive 3D = full 3JS / Three.js custom animation you describe. Available on Website, PWA, and Native — you choose.

Engagement types:

• From Scratch: No existing code. We create a new private GitHub repository for your project.
• Repo Provided / Conversion / Fix: You provide an existing GitHub repository or website. You grant us permission to fork it for development purposes.

2. Payment & Deposits

All projects require a 50% deposit to start. The remaining 50% is due upon approval of final preview, before code delivery.

• Website: $500 base ($250 deposit)
• Starter PWA: $750 total ($375 deposit)
• Growth PWA: $1,500 total ($750 deposit)
• Pro Business System: $2,500+ total (50% deposit)
• Native iOS & Android: Starting at $5,000 (50% deposit, fixed quote upfront)
• Add-ons (QR ordering, loyalty, GPS, chat, etc) quoted separately, 50% upfront

3. Development & Code Access Policy (Important)

To protect both parties:

• No Code Until Paid In Full: All work is done in a PRIVATE repository owned by Hextech Software. You will NOT have access to source code, commits, or GitHub during development.
• What You DO Get During Build: A live preview link (e.g., your-business.hextech-preview.vercel.app) to test on desktop and phone. You can share this with your team. Includes your chosen background style (Premium Clean or 3JS Immersive 3D).
• If You Provided A Repo: Your original repo remains untouched. We fork it privately to our org (hextech-software) and build in our fork. You will only receive a Pull Request or repo transfer AFTER final payment.
• If No Repo Provided: We create a new private repo from scratch. Ownership transfers to you only after final payment.

4. Refund Policy

Deposit is 100% refundable BEFORE you approve the final build and before code is shipped. — Love it or get your deposit back.

• After deposit, we will deliver a first preview within 3-7 business days (Website) or 5-10 days (PWA).
• If you are not satisfied with the direction, you may request a full refund. Upon refund, your preview link will be disabled and no code will be transferred. You keep your original repo (if provided), we keep our work.
• No refunds after final approval and final payment. Once you click "Approve & Pay Final Balance", you confirm acceptance of the work. At that point code ownership transfers and all sales are final, as you now possess the intellectual property (GitHub + DB + deployment).

5. Ownership & IP

Upon receipt of final payment, you own 100% of the final delivered source code, database schema, and your chosen background implementation (Premium Clean or 3JS/Three.js). You may host anywhere, hire anyone, or resell. Hextech Software retains no ownership after final payment.

Before final payment, all work, including private forks, commits, preview deployments, and 3JS assets, is owned solely by Hextech Software.

6. Revisions & Timeline

Timeline from deposit AND receipt of all content (logo, menu, photos, copy): Website 3-7 days, Starter PWA 5-10 days, Growth 10-14 days, Pro 14-21 days, Native 2-4 weeks. Includes 2 rounds of revisions after first preview. Additional revisions billed at $75/hr. Delays in providing content or feedback extend timeline.

Background style (Premium Clean vs 3JS Immersive) must be chosen at kickoff. Switching mid-build may incur fee if 3JS work has started.

7. Hosting & Maintenance

Managed Hosting $100/mo (Vercel + MongoDB Atlas) — includes SSL/lock icon auto-renew, daily DB backups, uptime monitoring, and up to 5 business email accounts (you@yourbusiness.com) via Gmail setup. Cancel anytime. After cancellation, you are responsible for hosting.

Your code lives on GitHub forever — you can self-host free anytime. Self-hosting support: 1 hour included after delivery.

8. Client Responsibilities

You agree to provide content, logos, photos, menu/prices, and timely feedback within 48 hours of preview. Delays in feedback extend timeline. For 3JS backgrounds, provide reference/inspiration if you have it — we will build custom Three.js scene to match.

9. Limitation of Liability

Service provided as-is. Hextech Software is not liable for indirect damages, lost profits, or third-party service outages (Stripe, Twilio, Google Maps, Google Play, App Store, Vercel, MongoDB). Max liability limited to amount paid.

10. Acceptance

By checking "I agree to Terms" and paying a deposit, you agree to these Terms. Electronic signature via checkbox, typed name, IP address and timestamp constitutes binding agreement under ESIGN Act.
